Providing Comprehensive Wine and Alcohol Beverage Law Services
Failure to properly comply with regulations such as preparation and filing of beverage license and permit applications, as well as labeling requirements at the state and federal levels for the manufacture, sale and import/export of wine and alcoholic beverage products, can result in serious consequences, including fines and license suspension or revocation. Our attorneys have experience with these regulations and work diligently to protect your interests.
The California Department of Alcoholic Beverages Control (ABC) issues and enforces liquor licenses and laws. Licenses issued include those for retail, such as stores, bars and restaurants. Non-retail include alcoholic beverage manufacture, winegrower, wholesaler, wine blender, importer and many more. Before a winery or vineyard can apply for an ABC license, it must already have approval by the planning department. A sales tax permit is also required before you can sell wine. To avoid delays when starting a new business, always consult with a business law attorney early in the process. The Barron Law Corporation will ensure your business complies with the myriad industry regulations and laws. We assist spirits, beer and wine producers, retailers, suppliers and distributors. We counsel clients on state and federal regulations on the production, labeling, marketing and distribution of wine, beer and spirits.
Federal law is governed by the Alcohol & Tobacco Tax and Trade Bureau (TTB), and it requires every winery to obtain a basic permit to engage in the business of selling alcohol. Bonded wine cellars also pay a tax. The ABC can request a valid certification by the TTB for each wine or alcoholic beverage label.
